1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Rozitech (Pty) Ltd ("Rozitech," "we," "us," or "our") governing your use of our software-as-a-service products, website, and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Rozitech provides cloud-based software solutions including but not limited to:

• AutoFlow AI - Workflow automation platform
• BuildEasy - No-code application builder
• TeamSpace - Team collaboration platform
• Custom SaaS development services
• Related support and consulting services

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice to users.

3. Account Registration

3.1 Account Creation

To use certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the confidentiality of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Restrictions

• You must be at least 18 years old to create an account
• One person or legal entity may not maintain more than one free account
• Accounts registered by automated methods are not permitted
• We reserve the right to refuse service or terminate accounts at our discretion

4. Acceptable Use

4.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree to use the Services in a manner consistent with all applicable laws and regulations.

4.2 Prohibited Use

You agree NOT to:

• Violate any laws, regulations, or third-party rights
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Services for illegal, fraudulent, or harmful purposes
• Interfere with or disrupt the Services or servers
• Scrape, mine, or harvest data from the Services without permission
• Resell or redistribute the Services without authorization
• Use the Services to send spam or unsolicited communications
• Impersonate any person or entity
• Reverse engineer or attempt to extract source code

5. Payment Terms

5.1 Subscription Fees

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are in South African Rand (ZAR) unless otherwise specified
• Prices are subject to change with 30 days' notice
• You authorize us to charge your payment method for all fees

5.2 Free Trials

• Free trials are offered at our discretion
• No payment information required for free trial signup
• Trial period is typically 14 days unless otherwise specified
• Features may be limited during the trial period

5.3 Refunds

• Monthly subscriptions: No refunds for partial months
• Annual subscriptions: Pro-rated refund within 30 days of purchase
• Custom development: Refunds determined on a case-by-case basis
• All refund requests must be submitted to billing@rozitech.com

6. Intellectual Property

6.1 Our Property

The Services and all associated intellectual property rights are owned by Rozitech. This includes but is not limited to:

• Software code and architecture
• User interfaces and designs
• Logos, trademarks, and branding
• Documentation and content
• Patents and trade secrets

6.2 Your Content

You retain all rights to the content you upload to our Services. By using our Services, you grant us a limited license to:

• Store, process, and display your content as necessary to provide the Services
• Create backups for disaster recovery purposes
• Share your content with third-party services you explicitly authorize

6.3 Feedback

Any feedback, suggestions, or ideas you provide about our Services become our property and may be used without compensation to you.

7. Data Protection

7.1 Data Security

We implement industry-standard security measures to protect your data, including:

• Encryption in transit and at rest
• Regular security audits and updates
• Access controls and monitoring
• Compliance with applicable data protection laws

7.2 Data Processing

Our processing of personal data is governed by our Privacy Policy. For business customers, we may enter into separate Data Processing Agreements as required.

7.3 Data Portability

You may export your data from our Services at any time using the available export features. We will assist with data migration upon account termination as reasonably requested.

8. Warranties and Disclaimers

8.1 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted or error-free service. Scheduled maintenance will be communicated in advance when possible.

8.2 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.3 No Professional Advice

Information provided through our Services is for general informational purposes only and should not be considered professional advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim
• We shall not be liable for indirect, incidental, special, or consequential damages
• We shall not be liable for loss of profits, data, or business opportunities
• These limitations apply regardless of the theory of liability

10. Indemnification

You agree to indemnify, defend, and hold harmless Rozitech and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or data

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Using the account closure feature in your settings
• Contacting support@rozitech.com
• Providing written notice to our registered address

11.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You fail to pay fees when due
• We are required to do so by law
• We discontinue the Services

11.3 Effect of Termination

• Access to the Services will cease immediately
• You remain liable for all fees incurred before termination
• We will delete your data after 90 days unless legally required to retain it
• Provisions that should survive termination will remain in effect

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending an email to registered users
• Displaying a notice in the Services

Your continued use of the Services after changes indicates acceptance of the modified Terms.

13. Governing Law

13.1 Applicable Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

13.2 Dispute Resolution

• We encourage resolution through good-faith negotiation
• If negotiation fails, disputes will be resolved through binding arbitration in Johannesburg, South Africa
• Each party bears its own costs unless the arbitrator determines otherwise
• Small claims court proceedings are exempt from arbitration

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.
